1. Scope and nature of the service

These Terms of Service (“Terms”) apply to your use of the website ve.ms and the tools and services offered on it (e.g. Mail Delivery Check, Mail Blacklist Check, Email Header Analyzer, Cookie & Tracking Check, Website Speed, Client Speedtest, DNS Lookup, WHOIS Lookup, and any future tools). The project is run as a hobby with a focus on non-commercial use. The tools are provided for informational and diagnostic purposes to support a safer and simpler internet. We do not guarantee availability, accuracy, or fitness for any particular purpose.

2. Non-commercial use and no guarantees

The tools and services are intended primarily for non-commercial, personal or educational use. Use in a commercial context (e.g. as part of a paid service or product) is not prohibited but is at your own risk. We give no performance guarantees, no uptime guarantees, and no guarantees as to the correctness or completeness of results. The tools are provided “as is”. We may change, limit, or discontinue tools or features at any time without notice. This is a volunteer-driven hobby project; we do our best but cannot promise enterprise-level support or availability.

3. Acceptable use — no misuse or abuse

You must use the site and tools in a lawful and responsible manner. In particular you must not:

• Use the tools to scan, probe, or request data from websites or systems without the consent of their owners (e.g. do not use our tools as part of unauthorised crawling, scraping, or automated access to third-party sites). Only use URLs and inputs that you are authorised to check.
• Use the tools to harass, spam, or abuse others (e.g. do not use mail-related tools to verify addresses for unsolicited mail).
• Attempt to circumvent rate limits, captchas, or other technical measures we use to ensure fair use and prevent abuse.
• Use the services for any illegal purpose or in a way that infringes the rights of others.
• Overload our systems (e.g. excessive automated requests) or use the tools in a way that could harm our infrastructure or other users.

We may restrict or block access (e.g. by IP or session) if we reasonably believe you are violating these rules or harming the service.

4. Your responsibility and liability for consequences

You are responsible for how you use the tools and for the consequences of that use. For example:

• If you use our tools to check domains or IPs that you do not own or have no permission to check, you may cause third parties to take action (e.g. blocklists, complaints). You can be held liable for such consequences (e.g. blacklistings, reputational or financial harm to you or others). We are not responsible for decisions made by third parties (e.g. blocklist operators, hosting providers) based on your use of our tools.
• Results from our tools (e.g. blacklist status, speed measurements, DNS or WHOIS data) are for information only. Relying on them for critical decisions is at your own risk. We do not accept liability for losses arising from such reliance.
• If your use of our tools causes damage to us or to third parties (e.g. due to misuse, breach of these Terms, or violation of law), you may be liable to us or to those third parties to the extent permitted by applicable law.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law. Otherwise, our liability is limited to the maximum extent permitted by law.

5. Intellectual property and content

The website and tools, including their design, text, and code (to the extent we own or license them), are our property or used under licence. You may use the site and tools in accordance with these Terms but do not acquire any rights to our branding, design, or underlying technology. You remain responsible for any content you submit (e.g. URLs, email addresses); you must have the right to use and to allow us to process it for the purpose of providing the tool.

6. Privacy

Your use of the site and tools is also governed by our Privacy Policy. By using the site you acknowledge that we process data as described there (e.g. for operation, rate limiting, and providing the tools).

7. Changes to the Terms

We may change these Terms from time to time. The current version will be published on this page. If we make material changes, we may indicate the date of the last update. Continued use of the site after changes constitutes acceptance of the updated Terms where permitted by law. If you do not agree, you must stop using the site and tools.

8. Severability and governing law

If any part of these Terms is held to be invalid or unenforceable, the remaining parts remain in effect. These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. For disputes arising from or in connection with these Terms or the use of the site, the courts of Germany have jurisdiction to the extent permitted by law.
